DUI Athens GA: Georgia Police Use Advanced Drunk Driving Detection Techniques
Police officers use a breathalyzer to test a driver’s blood alcohol content. The permissible blood alcohol level in Georgia is .08. If caught driving with a blood alcohol content of .08 or above in Georgia, the driver will be charged with DUI. The permitted level for minor drivers is .02. For commercial drivers, the limit is .04. Anyone with a blood alcohol level of .15 or more may be subject to higher penalties.
In Georgia the police generally use the Intoxilyzer 5000. The Intoxilyzer 5000 is generally considered accurate but can be affected by body temperature, electrical currents, breath sprays and other conditions including the condition of the device and the officer’s training in using the device.
To count the blood alcohol level, the officer will ask the driver to blow into the Intoxilyzer 5000 for a certain period of time. People suffering from pulmonary or other health conditions are generally unable to blow into the machine long enough to generate an accurate reading.
Refusal to take a breathalyzer test can result in suspension or revocation of license. If the driver refuses to take a breathalyzer test, the police officer must read out an Implied Consent Form informing the driver of the consequences.
